Privacy Policy

Last updated September 17, 2026

This policy explains what The Law Office of Mark E. Braswell, P.C. (“the firm”, “we”, “us”) collects when you call us or submit our form, what we do with it, who we give it to, and how you get it corrected or deleted. It applies to this website, our intake phone line, and the emails and text messages we send in response to an inquiry.

Contacting us does not make you a client. No attorney–client relationship exists until you and the firm sign a written agreement, and until then we are not acting as your lawyer and nothing we say is legal advice about your situation. We do treat what you tell us as confidential under our professional obligations to prospective clients — but until we have run a conflicts check and agreed to take the matter, send us only the basics, not detailed facts, documents or anything you would not want a lawyer who cannot represent you to have seen.

Mobile information and text messaging

We do not share your mobile information for marketing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Text messaging consent is collected separately from every other permission on our form, in its own unchecked checkbox, and it is optional. You can submit the form, and we will call you, without ever agreeing to receive a text. Consent to receive text messages is never a condition of speaking with us or of the firm considering your inquiry.

Our text messages are non-marketing: they relate to an inquiry you submitted and its status, up to 5 messages a month. Message and data rates may apply. Reply STOP to any message to opt out and HELP for help. Full messaging terms, including the program description and carrier disclaimers, are in our Terms of Use and Messaging Terms.

What we collect

Information you give us

When you submit our call-back form, we collect:

If you call us instead, we collect the same categories of information over the phone. We will also ask on the call whether another lawyer already represents you on this matter, so that we do not contact a represented party, and we run a conflicts check before going further.

Information about your incident is sensitive

The incident type, its date and whether you have received medical treatment describe your physical health. Texas law treats that as sensitive personal data, and we collect it only with your consent — the consent you give by checking the required box on our form or by telling us over a recorded line. We collect the minimum needed to work out whether this is the kind of matter the firm takes. Do not send us medical records, imaging, bills or diagnoses. We do not need them and we do not want them in our systems.

Information we collect automatically

Call recording

Calls to and from our intake line are recorded, for quality and as a record of what was said and agreed. This is disclosed on the page before you dial, on the call itself, and here. If you do not want to be recorded, use the form instead and ask us to contact you by email.

Why we use it, and on what basis

PurposeWhat it involves
Responding to your inquiryCalling or emailing you about the request you submitted, and following up if we cannot reach you.
Assessing your inquiryWorking out whether this is the kind of matter the firm takes, and running a conflicts check before we go further.
Proving consentKeeping the timestamp and IP address that show you authorized contact. This protects you as much as us.
Honoring opt-outsKeeping a record of anyone who has asked not to be contacted, so the request is not lost. See our Do Not Call & Opt-Out policy.
Preventing abuseRate limiting, bot detection and fraud prevention on our form.
Measuring advertisingUnderstanding which ads produce genuine inquiries, as described under Advertising measurement.

Who we share it with

Inside the firm

Your inquiry goes to the firm — to Mark Braswell and to the staff working the matter under his supervision. It is not passed to any other law firm, and we do not refer or sell inquiries on. You are never obligated to hire us.

If you tell us another lawyer already represents you on this matter, we stop and do not contact you further about it.

Service providers

We use a small number of vendors to run this service. They may process your information only on our instructions and only to provide their service:

What we never do

We may disclose information where the law requires it — a subpoena, a court order or a regulator’s lawful request — or to establish or defend a legal claim.

Advertising measurement

Our ads run on Meta platforms. When you submit the form, we send Meta an event recording that an inquiry happened. Your name, email and phone number are irreversibly hashed (SHA-256) before they leave our server, so Meta receives a fingerprint rather than your details. We also send your IP address and browser user agent, which Meta uses for matching.

We deliberately send no value, amount or case information with these events. Putting a monetary value on an injury inquiry would be a case valuation, and no one can responsibly make one from a web form.

You can limit this with Meta’s own controls in your Facebook or Instagram account settings, and with your browser’s cookie controls.

Cookies and similar technology

This site sets no advertising cookies of its own. Meta’s pixel, when enabled, sets _fbp and reads _fbc from the link you arrived on. Our form uses your browser’s session storage to carry an event identifier from the form to the confirmation page, which prevents the same inquiry being counted twice. Blocking cookies does not stop the form working.

How long we keep it

If you ask us to delete your information, we will — but we keep the minimum record needed to honor an opt-out and to show that we did. That record contains your contact details and nothing about your incident.

Your rights

If you are a Texas resident, the Texas Data Privacy and Security Act gives you the right to:

Use the contact details below. We will verify who you are before acting, and respond within 45 days, which we may extend once by a further 45 days where the request is complex. There is no charge for the first request in a twelve-month period.

If we refuse your request, you may appeal. Reply to our decision saying you wish to appeal. We will respond in writing within 60 days and, if we still refuse, tell you how to complain to the Texas Attorney General.

Residents of other states may have similar rights. Ask us and we will apply the same process.

Security

Submissions travel over an encrypted connection and are written to our own database before anything else happens to them, so a downstream outage cannot lose a record. Access is limited to people who need it to work an inquiry. No system is perfectly secure, and we do not claim otherwise.

Children

This service is for adults. We do not knowingly collect information from anyone under 18. If you believe a child has submitted information, tell us and we will delete it. A parent or guardian should make an inquiry on a minor’s behalf.

Changes

If we change this policy we will update the date at the top. Material changes to how we handle mobile information or consent will be posted here before they take effect.
